InnerBloomin Terms of Service

1. Agreement to Terms

By downloading, installing, or using InnerBloomin ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Babwani Technologies LLC ("we," "us," or "our").

2. Description of Service

InnerBloomin is an AI-powered voice journal application designed to help users master their mental fitness through daily reflection and AI-generated insights.

• Voice-to-text journaling using AI transcription
• AI-powered insights and responses to your reflections
• Emotional tracking and journey visualization
• Daily motivational notifications
• Seasonal background themes
• Free and Premium subscription tiers

3. Eligibility and Account

Age Requirement:

You must be at least 13 years old to use InnerBloomin. Users under 18 should have parental or guardian consent.

No Account Required:

InnerBloomin does not require account creation. All data is stored locally on your device. You are responsible for protecting your device with a passcode or biometric lock if you want to keep your journal private.

Free Tier:

• 5 daily reflections with intelligent AI processing
• English language journaling only
• AI text insights for your reflections
• Access to all core features including voice journaling, emotional tracking, and journey visualization

Premium Tier ($9.99/month or $79.99/year):

• Unlimited daily reflections - 3 priority AI reflections + unlimited additional reflections (never locked out)
• 99+ languages - Journal in any language, AI responds in your language
• AI voice companion - Full voice journaling with conversational AI insights
• Deep emotional insights - Advanced AI analysis beyond basic text processing
• Priority AI processing - First 3 daily reflections use our most advanced AI models
• Intelligent processing - Seamless smart AI for unlimited additional reflections
• All future premium features - Insights dashboard, custom themes, data export, and more
• Annual plan saves 33% - $79.99/year ($6.67/month) vs $119.88 if paid monthly

Reflection Packs (One-Time Purchase):

For Free users who want extra reflections without subscribing to Premium:

• 5 Reflections Pack: $3.99 - Add 5 high-quality reflections to your daily limit
• 10 Reflections Pack: $6.99 - Add 10 reflections (best value for occasional use)
• 30 Reflections Pack: $14.99 - Perfect for intensive journaling periods

Note: Packs are one-time purchases that add to your reflection balance. They do not expire and can be used at your own pace.

Subscription Terms:

• Subscriptions are managed through Apple's App Store
• Payment charged to your Apple ID account at purchase confirmation
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Account charged for renewal within 24 hours prior to the end of current period
• Subscriptions can be managed and cancelled in App Store account settings
• No refunds for partial months or unused portions
• Pricing subject to change with 30 days notice

Reflection Pack Terms:

• Reflection packs are one-time, non-recurring purchases
• Packs add reflections to your account balance that can be used at any time
• Purchased reflections do not expire and carry over indefinitely
• Pack reflections are separate from daily free reflections
• No refunds for purchased packs once reflections are used
• Premium subscribers do not need packs (unlimited reflections included)

• Never locked out: Free users hit daily limits. Premium users never do.
• Your language, your voice: Journal in 99+ languages - Spanish, Mandarin, Hindi, Arabic, French, and more. AI responds in your native language.
• True AI companion: Voice journaling with conversational AI that speaks back to you, not just text responses.
• Deep understanding: Premium AI goes beyond surface-level insights to understand emotional nuance and context.
• Build the habit: Mental fitness requires consistency. Premium lets you reflect as often as needed without artificial barriers.
• Optimized intelligence: We use the best AI model for each reflection while keeping costs sustainable for unlimited usage.
• Future-proof: New features (export, insights dashboard, custom themes) will be Premium-only.

Free Trial (if offered):

If a free trial is offered, it will be clearly disclosed before purchase. If you don't cancel before the trial ends, you'll be charged the subscription price.

5. Acceptable Use Policy

You agree to use InnerBloomin only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal, harmful, or fraudulent purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Extract or scrape AI responses for training other AI models
• Use the App to harass, abuse, or harm others
• Attempt to gain unauthorized access to any part of the App
• Upload malicious code, viruses, or harmful content
• Share your subscription access with others
• Use the App in a way that could damage, disable, or impair the service
• Use automated systems or bots to access the App

6. User Content and Ownership

Your Content:

You retain all rights to the content you create in InnerBloomin, including voice recordings, transcriptions, and journal entries ("Your Content").

License to Us:

By using the App, you grant us a limited license to:

• Process your voice recordings through AI transcription services
• Analyze your content to generate AI insights
• Store your content locally on your device

This license is solely for providing App functionality. We do not use your content for any other purpose, including training AI models or marketing.

AI-Generated Content:

AI-generated insights and responses are provided "as is" for reflection purposes. You may use these insights personally, but they are generated by AI and should not be relied upon as professional advice.

You acknowledge and agree that:

• AI-generated insights are not perfect and may contain errors
• AI responses are based on patterns, not human understanding
• AI cannot replace human empathy, judgment, or professional expertise
• Transcriptions may contain inaccuracies or misinterpretations
• Emotional detection is approximate and may not be accurate
• We do not guarantee accuracy, completeness, or reliability of AI insights

9. Intellectual Property Rights

Our Rights:

InnerBloomin, including its design, features, code, graphics, and interface, is owned by Babwani Technologies LLC and protected by copyright, trademark, and other intellectual property laws.

Restrictions:

You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Remove or alter copyright notices or branding
• Use our trademarks without written permission

10. Privacy and Data Protection

Your use of InnerBloomin is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy points:

• Your data is stored locally on your device
• We do not collect analytics or track your behavior
• AI processing is done through secure, privacy-respecting APIs
• You can delete your data at any time

11. Termination and Suspension

Your Right to Terminate:

You may stop using InnerBloomin at any time by:

• Deleting all your data within the app
• Uninstalling the app from your device
• Cancelling your Premium subscription (if applicable)

Our Right to Terminate:

We reserve the right to suspend or terminate your access to InnerBloomin if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse or misuse the service
• Required by law or regulatory authorities

Effect of Termination:

• Your subscription (if active) will be cancelled
• You will lose access to Premium features (if applicable)
• Local data remains on your device until you delete it
• No refunds for unused subscription time

12. Disclaimers and Limitations of Liability

No Warranties:

We disclaim all warranties, express or implied, including:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of AI insights
• Uninterrupted or error-free operation
• That the App will meet your specific needs
• That defects will be corrected

Limitation of Liability:

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for Premium subscription in the past 12 months (or $100 if you're a Free user)
• We are not responsible for damages resulting from your use or inability to use the App
• We are not liable for third-party services (AI providers, Apple, etc.)

13. Indemnification

You agree to indemnify and hold harmless Babwani Technologies LLC, its officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any third-party rights
• Your violation of any applicable laws

14. Changes to the App and Terms

Changes to the App:

We may:

• Modify, update, or discontinue features at any time
• Change Premium pricing with 30 days notice to existing subscribers
• Add new features or remove existing ones
• Temporarily suspend the service for maintenance

Changes to Terms:

We may update these Terms at any time. Material changes will be communicated through:

• In-app notification
• Update to the "Last Updated" date
• Email (if you've provided one for support)

Continued use after changes means you accept the new Terms. If you disagree, stop using the App.

15. Third-Party Services and Links

InnerBloomin integrates with third-party services:

• OpenAI (Whisper API for transcription, GPT API for insights)
• Anthropic (Claude API for insights)
• Apple (StoreKit for subscriptions, Notifications)

These services have their own terms and privacy policies. We are not responsible for their practices or availability.

The App may contain links to third-party websites. We do not endorse or control these sites and are not responsible for their content.

16. Governing Law and Dispute Resolution

Governing Law:

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

Dispute Resolution:

For any disputes arising from these Terms or your use of the App:

• Contact us first at babwanitechnologies@gmail.com to resolve informally
• If informal resolution fails, disputes will be resolved through binding arbitration
• Arbitration will be conducted under the American Arbitration Association rules
• You waive the right to participate in class action lawsuits

Exceptions:

Either party may seek injunctive relief in court for intellectual property violations or unauthorized use.

17. Apple-Specific Terms

If you downloaded InnerBloomin from the Apple App Store, these additional terms apply:

• These Terms are between you and Babwani Technologies LLC, not Apple
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for product liability claims
• Apple is not responsible for addressing warranty claims
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with Apple's Media Services Terms and Conditions

18. General Provisions

Entire Agreement:

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding InnerBloomin.

Severability:

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

Waiver:

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment:

You may not assign these Terms to anyone else. We may assign these Terms to any affiliate or successor.

Force Majeure:

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, pandemics, internet outages, etc.).
